To Whom it May Concern,
Pursuant to Article I, Section 2, Clause 3 of the Constitution, the only information you are empowered to request is the total number of occupants at this address. My “name, sex, age, date of birth, race, ethnicity, telephone number, relationship and housing tenure” have absolutely nothing to do with apportioning direct taxes or determining the number of representatives in the House of Representatives. Therefore, neither Congress nor the Census Bureau have the constitutional authority to make that information request a component of the enumeration outlined in Article I, Section 2, Clause 3. In addition, I cannot be subject to a fine for basing my conduct on the Constitution because that document trumps laws passed by Congress.

“Neither branch of the legislative department [House of Representatives or Senate], still less any merely administrative body [such as the Census Bureau], established by congress, possesses, or can be invested with, a general power of making inquiry into the private affairs of the citizen. Kilbourn v. Thompson, 103 U.S. 168, 190. We said in Boyd v. U.S., 116 U. S. 616, 630, 6 Sup. Ct. 524,―and it cannot be too often repeated,―that the principles that embody the essence of constitutional liberty and security forbid all invasions on the part of government and it’s employees of the sanctity of a man’s home and the privacies of his life. As said by Mr. Justice Field in Re Pacific Ry. Commission, 32 Fed. 241, 250, ‘of all the rights of the citizen, few are of greater importance or more essential to his peace and happiness than the right of personal security, and that involves, not merely protection of his person from assault, but exemption of his private affairs, books, and papers from inspection and scrutiny of others. Without the enjoyment of this right, all others would lose half their value.’”

Note: This United States Supreme Court case has never been overturned.

Great post. Hope freedom would exists in the end. March 2nd is Texas Independence Day – alternatively known as International White People Stealing from Mexico Day. (I'm not judging.) The Republic of Texas declared it's independence from Mexico on March 2nd, 1836, and was annexed by the US as a state 10 years later. You don't necessarily need to get payday loans to celebrate, quote unquote Texas style – just get some Shiner Beer (a German Bock style lager) and barbecue – Texan BBQ is famous (rightly so) for slow cooked beef brisket, and relies on correct cooking to seal in flavor instead of sauce.

There are no "qualifications" for Auditor like there are for DA for example (must be a lawyer and a member of the Mass Bar to run). Second, the job is basically to oversee the ones who do most of the actual accounting work. Jain would first make publicly available all financial transactions of the State on the web so any of us could see where the gov't is spending its money. No qualifications needed to do that. Second, he would be the one state government elected official to stop LYING to the citizenry about the "budget" and all matters dealing with state finances. I would expect Jain to be VISIBLE and accountable to the public unlike the current auditor DiNucci. He would tell it like it is (as he is already doing) about the four "budgets" Mass has as well as off budget spending.

Anyway, my point is, you can bash Jain before he has a chance to officially start his campaign or you can look at who we could have instead- Mary Connaughton who has been in state government before (Turnpike board, etc) and is the Entrenched Establishment's pick.

Alexa ratings have Kain's site ranked 6,934,739 to Connaughton's 14,385,657. It looks like he is getting more "traffic" on his campaign.

I am (ahem) apparently one of those lap dogs you decry in the February newsletter's "Precinct Project Advances." I won a contested write-in election for Republican State Committee Man for the First Middlesex state senatorial district.

To win, I canvassed door to door, compiled public voter registration and performance information from my district's municipalities (i.e., identified who actually shows up to vote consistently), sent a mailer to the 3800 high-probability folks out of 88,000 registered voters, appeared on a local cable-access show and then got the various local cable committees to run it across the district, and designed and produced a voter guide / sticker system approved for a voter to carry into the polls with him. I spent $1300 of my own money in addition to the $300 in donations that I was astonished to have received.

Yes, the state committees do vote policy, budget and chairman for their parties. They also supervise local convention delegate-selection caucuses. Somebody has got to assume the responsibility and liability for that, and in our (small-r) republican form of government, it is the party state committees. The meetings are public, with proceedings recorded in minutes and dates posted well in advance. The same is true for duly constituted local ward and town committee meetings.

The fundamental goal of party committees at every level is to get their candidates elected. What could be simpler and more transparent than that?

Sometimes we do extracurricular activities. For example, I managed a telephone bank on behalf of a wonderful (though unsuccessful) candidate for the Second Middlesex House District. We completed 33% more calls than the Campaign requested. I also wrote software to help me schedule and track the volunteer callers' efforts.

I can't speak for the Dems, but we GOP folks have all kinds in our state committee. We have constitutional strict constructionists vs. blunt pragmatists, a few old-money types whose participation goes back several generations, ardent feminists, pro-life vs. pro-choice vs. "don't bring that subject up" people, western MA and cape & islands residents who resent being ignored by Beacon Hill, some social climbers / wannabes, successful political hired guns / still more wannabes, urban vs. suburban vs. ex-urban mentalities, ethnic and racial variations, spare-haired old gray heads vs. younger folks etc. You name it, we've got it. They all have in common that they were elected to office.

It's not such a fabulous office. It is strictly voluntary, at zero pay. It does not legislate public policy, spending or revenue. (If you enjoy holding a gun to the citizenry for money, run for the legislature, not the state committee.) It exposes the officeholder to liability. Pretty much, it's the "dog catcher" of elected Massachusetts offices.

Factual corrections to your article:

1) Delegate rules vary from one convention to another and are up to the individual political parties as approved by their state committees. (We had a few skirmishes over these in the GOP state committee, let me tell you!) In particular, the GOP rules this time provide one elected delegate slot for every 300 votes cast in favor of Gov. Romney's election, rounded upward for any remainder after computing that division.

2) I am not a "default" delegate. I am an ex officio (Latin for "by virtue of office") delegate. Other GOP ex officio GOP delegates this time are county sheriffs, mayors and city councilors, chairmen of local GOP committees, and school committee members

3) Bicameral has nothing to do with your point in the final paragraph of your article. The camerae (Latin for chambers) are the House and Senate. Context suggests you mean "bipartisan."

4) No state has been sovereign since approving the Constitution of the United States. If you really want Massachusetts sovereignty restored, you are talking secession. Wow, imagine Shay's Rebellion and the Civil War all over again.

Lastly, what exactly is "all the trouble" that the two parties have caused? A party coalesces because people of similar outlook figure they will get farther by banding together based on their similarities than running away based on their differences. Political party official and defacto platforms evolve constantly. They morph quickest in response to elections. (For instance, Chicago community organizer-style Hope 'n' Change has not worked out so well for the Dems, who are therefore rethinking things.)

Two parties tend to predominate in the United States because three or more would result in an unstable system that naturally collapses back to two. That is not to say that a vibrant new party cannot overrun an older one. (When was the last time you saw the Whig party on the ballot?) For example, the nascent Republican Party gained strength by being on the correct and popular side of abolishing slavery in this country. The Dems opposed abolition.

Want multiple parties? It's easily done by replacing a popularly elected president with a powerful prime minister elected by the national legislature. If this appeals to you, Italy beckons.

2-9-2010 - I just got an update from Sen. Bob Hedlund that the bill is NOT Dead yet. The conference committee could still address this legislation in the months to come. We are hoping that as we get past the "flu season" that it will die in committee. As the threat to contracting the flu dimishes, so does the possibilty that this bill will be redressed. The key date to look forward to is July 31st. This is when the possibility for the committee to reconvene will have passed. The bill will not be offficially dead until Jan 2nd 2011.

Kamal is making two political miscalculation. First to run for Auditor in the first place, it is a position for which he is not qualified.

The second is forgoing independant status and going directly on the November ballot as there are two other Republicans seeking the position.
